1. ACCEPTANCE OF TERMS

By accessing or using MY RAD SET (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you don't agree with these terms, please don't use the Service. These Terms apply whether you're using the web app, mobile app, or any other platform we offer.

2. DESCRIPTION OF SERVICE

MY RAD SET is a band setlist management application that helps musicians:

• Organize songs and create setlists
• Collaborate with band members
• View performance-optimized displays with auto-scroll
• Access guitar/bass fretboards and piano references
• Record rehearsals (stored locally on your device)
• Share setlists with bandmates

3. USER ACCOUNTS

Account Creation

You must create an account to use MY RAD SET. When creating an account:

• Provide accurate and current information
• You're responsible for maintaining account security
• You're responsible for all activities under your account
• Notify us immediately of any unauthorized access
• You must be 13 or older (with parental consent if under 18)

Account Termination

You may delete your account at any time. We may suspend or terminate accounts that violate these Terms, without prior notice.

4. SUBSCRIPTION & PAYMENTS

Free Tier

MY RAD SET offers a free tier with access to core features. Free users may have limitations on:

• Number of songs or setlists
• Number of bands
• Storage limits for local recordings

Premium Subscription

Premium features are available through subscription:

• Monthly: $3.99/month
• Lifetime: $49.99 one-time purchase

Premium benefits include:

• Unlimited songs and setlists
• Unlimited bands and collaborations
• Advanced features and early access to new tools
• Priority support
• Future cloud storage for recordings (when available)

Payment Terms

• Payments are processed through Stripe, Apple App Store, or Google Play
• Subscriptions auto-renew unless cancelled
• You can cancel anytime (no refunds for partial months)
• Lifetime purchases are non-refundable after 30 days
• Prices may change with 30 days notice to existing subscribers

Refunds

We offer refunds within 30 days of purchase if you're not satisfied. Contact support@myradset.com to request a refund.

5. USER CONTENT & OWNERSHIP

Your Content

You retain all rights to content you create in MY RAD SET:

• Songs, lyrics, and notes
• Setlists and arrangements
• Audio recordings
• Band information

License to Us

By using MY RAD SET, you grant us a limited license to:

• Store and display your content within the Service
• Enable features like sharing and collaboration
• Make backup copies for security

We will never: Sell your content, use it for advertising, or share it without your permission.

Copyright and Licensing

6. ACCEPTABLE USE

You Agree NOT To:

• Violate any laws or regulations
• Infringe on others' intellectual property rights
• Upload malicious code or viruses
• Harass, abuse, or harm other users
• Attempt to hack or compromise the Service
• Create multiple accounts to bypass limitations
• Sell or transfer your account
• Use automated tools to scrape or access the Service
• Impersonate others or provide false information
• Share inappropriate, offensive, or illegal content

7. BAND COLLABORATION

When collaborating with bands:

• Band owners control member permissions
• Members can view/edit based on their role (owner, editor, viewer)
• You're responsible for managing your band's membership
• Respect other band members' contributions
• Band owners can remove members at any time

MY RAD SET and all related trademarks, logos, and content are owned by us or our licensors. You may not:

• Copy, modify, or create derivative works
• Reverse engineer the Service
• Remove copyright or trademark notices
• Use our branding without permission

10. PRIVACY

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information.

11. THIRD-PARTY SERVICES

MY RAD SET integrates with third-party services:

• Clerk: Authentication and user management
• Payment Processors: Stripe, Apple, Google

These services have their own terms and privacy policies. We're not responsible for third-party services.

12. DISCLAIMERS & LIMITATIONS

Service Availability

We strive for 99.9% uptime, but we don't guarantee uninterrupted service. MY RAD SET is provided "as is" and "as available."

No Warranties

We make no warranties about:

• Accuracy or reliability of the Service
• Fitness for any particular purpose
• Error-free or secure operation
• Compatibility with all devices

Limitation of Liability

13. INDEMNIFICATION

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any laws or third-party rights
• Content you upload or share

14. CHANGES TO TERMS

We may update these Terms from time to time. We'll notify you of material changes via:

• In-app notification

Your continued use after changes means you accept the new Terms.

15. TERMINATION

Either party may terminate this agreement:

• You can export your data before deletion
• Subscriptions are non-refundable

Arbitration

Any disputes will be resolved through binding arbitration rather than court, except for:

• Small claims court cases
• Intellectual property disputes
• Injunctive relief requests

Class Action Waiver

You agree to resolve disputes individually and waive the right to participate in class actions.
